TERMS AND CONDITIONS

These Terms and Conditions apply to the use of www.sombreroroad.com and to direct reservations made for Blue Island at Marathon. The website and property are operated by Blue Island at Marathon LLC.

By accessing this website, submitting an inquiry, or completing a reservation, you acknowledge and agree to these Terms and Conditions. The guest completing the reservation is responsible for ensuring that all members of the group and approved visitors comply with these terms, the property rules, and the applicable rental agreement.

RESERVATIONS AND PAYMENTS

A reservation is not confirmed until the required payment has been successfully processed and written confirmation has been issued.

Rates, taxes, cleaning fees, management fees, deposits, payment schedules, minimum-stay requirements, and other applicable charges will be displayed during the booking process or stated in the reservation confirmation.

The guest is responsible for providing accurate contact, payment, and occupancy information. Blue Island at Marathon LLC reserves the right to cancel a reservation obtained using inaccurate, incomplete, or fraudulent information.

CANCELLATIONS AND REFUNDS

The cancellation policy presented at the time of booking applies to the reservation. Guests should review all cancellation deadlines and refund conditions before completing payment.

Refunds will not be provided for late arrivals, early departures, weather conditions, travel interruptions, personal circumstances, or dissatisfaction with conditions outside the reasonable control of Blue Island at Marathon LLC, except when otherwise required by law or expressly stated in the applicable cancellation policy.

OCCUPANCY AND GUESTS

The property permits a maximum of 12 overnight guests. Only registered guests may stay overnight.

Additional visitors, private celebrations, or gatherings require prior written approval. Parties, unauthorized events, and disruptive conduct are prohibited.

The person completing the reservation is responsible for the conduct of all guests and visitors and for any damage, excessive cleaning, fines, or expenses resulting from their stay.

PROPERTY RULES

Pets are not permitted.

Quiet hours begin at 10:00 PM. Guests must respect neighboring properties and comply with all applicable laws, ordinances, and noise restrictions.

Vehicles must be parked entirely within the property driveway. Street blocking and unauthorized parking are prohibited.

Smoking or vaping is not permitted inside the home.

Guests may not disconnect safety equipment, tamper with cameras or alarms, or use the property for unlawful or commercial purposes.

CHECK-IN AND CHECKOUT

Standard check-in is at 4:00 PM, and checkout is at 10:00 AM, unless otherwise approved in writing.

Early check-in and late checkout are not guaranteed and depend on availability and the cleaning schedule. Unauthorized late departures may result in additional charges.

PROPERTY CARE AND DAMAGES

Guests must leave the property in reasonably clean condition and promptly report damage, malfunction, accident, or safety concern.

The booking guest is financially responsible for damage, missing items, excessive cleaning, rule violations, unauthorized guests or pets, and other losses caused by members of the group or approved visitors.

AMENITIES AND ASSUMPTION OF RISK

The property includes a swimming pool, spa, dock, kayaks, bicycles, fitness equipment, outdoor cooking equipment, fire features, stairs, balconies, and other recreational amenities.

Guests use these amenities at their own risk and are responsible for appropriate supervision, particularly for children and individuals who cannot swim. Children must be supervised by a responsible adult at ALL times around the pool, spa, dock, canal, balconies, stairs, and recreational equipment.

Guests must follow all posted instructions and may not operate equipment while impaired or in an unsafe manner.

BOATING, DOCK AND WATER CONDITIONS

Canal depth, tides, currents, navigability, clearance, and water conditions vary. Guests are responsible for independently determining whether the canal and dock are suitable for their vessel.

Blue Island at Marathon LLC does not guarantee specific water depth, vessel clearance, navigability, fishing conditions, or uninterrupted access to the Atlantic Ocean.

                               IMPORTANT

Seasonal sargassum, marine vegetation, odors, insects, wildlife, weather, tides, and other natural conditions may occur and are outside the reasonable control of Blue Island at Marathon LLC.

POOL AND SPA

We want our guests to fully enjoy the private pool and spa during their stay. When reasonably possible, we will gladly try to accommodate requested temperature adjustments and operating schedules.

Pool and spa temperatures may be affected by weather conditions, outside temperatures, equipment capacity, maintenance requirements, and other factors beyond our reasonable control. For these reasons, an exact water temperature cannot be guaranteed.

Guests may not alter or tamper with the pool, spa, heating, or control equipment. Any requested adjustments should be submitted directly to us.

Temporary interruptions caused by weather, maintenance, utility disruptions, or equipment failure will be addressed as promptly as reasonably possible but do not automatically entitle the guest to a refund.

SECURITY AND EXTERIOR CAMERAS

The property uses security cameras located Only in exterior areas for safety, security, and property protection. There are no cameras inside the home.

Guests may not cover, disconnect, reposition, or otherwise interfere with security cameras, smoke alarms, carbon monoxide detectors, pool alarms, or other safety equipment.

WEATHER, UTILITIES AND EVENTS BEYOND OUR CONTROL

Blue Island at Marathon LLC is not responsible for events beyond its reasonable control. Temporary interruptions caused by weather, maintenance, utility disruptions, or equipment failure will be addressed as promptly as reasonably possible. We will always make every reasonable effort to restore service and keep guests informed.

WEBSITE INFORMATION

Blue Island at Marathon LLC makes reasonable efforts to keep website descriptions, photographs, rates, and availability accurate. Minor differences, updates, repairs, replacements, or improvements may occur.

Website content, photographs, logos, and written materials may not be copied, reproduced, republished, or used commercially without written permission.

RESERVATION TERMS

These Terms and Conditions, together with the reservation confirmation, payment and cancellation policies displayed at the time of booking, and the property rules provided to the guest, constitute the terms applicable to the reservation. If there is a conflict, the reservation-specific terms accepted during booking will control.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Blue Island at Marathon LLC will not be responsible for indirect or consequential losses, loss of personal property, injuries resulting from unsafe or unauthorized conduct, or conditions beyond its reasonable control.

Nothing in these Terms and Conditions excludes liability that cannot legally be excluded or limited.

GOVERNING LAW

These Terms and Conditions are governed by the laws of the State of Florida. Any dispute will be subject to the applicable jurisdiction and venue in Monroe County, Florida, unless otherwise required by law.
